1. Acceptance of Terms
Welcome to Luxury Transformations ("Service," "we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of our virtual staging platform located at luxurytransformations.vip and any related services, features, content, or applications offered by Luxury Transformations.
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.
IMPORTANT: THESE TERMS CONTAIN A MANDATORY ARBITRATION PROVISION IN SECTION 14 THAT REQUIRES THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTIONS.
2. Eligibility
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.
3. Account Registration and Authentication
3.1 Authentication Methods
To access certain features of the Service, you must authenticate using Google SSO or Apple SSO. We do not offer email and password authentication.
3.2 Account Security
You are responsible for maintaining the security of your authentication credentials. You agree to notify us immediately of any unauthorized access to your account.
3.3 Single-User Accounts
Each account is for individual use only. Multi-seat, team sharing, or organization-wide accounts are not permitted under this version of the Service.
4. Service Description
4.1 Virtual Staging Service
Luxury Transformations provides AI-powered virtual staging services for real estate professionals. You may upload images of vacant rooms and receive digitally staged versions of those rooms.
4.2 Free Trial
New users receive one free room staging, which includes:
- Three low-resolution, watermarked preview images
- One high-resolution final image (upon authentication)
- One regeneration opportunity
4.3 Paid Plans
- Single Room: 1 room for $59 USD
- 5 Rooms: 5 rooms for $239 USD
- 10 Rooms: 10 rooms for $449 USD
4.4 Room Credits
Room credits do not expire but are non-refundable and non-transferable. Credits cannot be redeemed for cash.
5. Usage Restrictions and Abuse Prevention
5.1 Abuse Controls
- One free room per session
- Maximum of two free rooms per IP address per 48 hours
5.2 Prohibited Activities
You agree not to:
- Circumvent abuse prevention measures or usage limits
- Use automated systems or bots to access the Service
- Upload images that violate third-party rights or contain illegal content
- Attempt to reverse engineer or extract our AI models or prompts
- Resell or redistribute images generated by the Service without proper licensing
- Use the Service for any unlawful or fraudulent purpose
6. Intellectual Property Rights
6.1 Your Content
You retain all ownership rights to the images you upload ("Your Content"). By uploading Your Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and process Your Content solely for the purpose of providing the Service.
6.2 Generated Images
Upon payment and completion of a staging job, you receive a commercial license to use the generated images for real estate marketing purposes, including MLS listings, promotional materials, and property websites. This license is perpetual and non-exclusive.
6.3 AI Disclosure
Generated images may contain optional metadata indicating they were created using artificial intelligence. You are responsible for complying with all applicable MLS rules and regulations regarding disclosure of virtually staged images.
8. Payment Terms
All payments are processed through Stripe. By making a purchase, you agree to Stripe's terms of service and privacy policy.
All sales are final. Room credits are non-refundable once purchased.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUXURY TRANSFORMATIONS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
14. Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
You and Luxury Transformations agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be settled by binding arbitration, except that each party retains the right to seek injunctive or other equitable relief in a court of competent jurisdiction.
